Welcome to rekndle! This document outlines the guidelines and limitations that apply to your interaction with our website(s), products, services, and applications (collectively, the “Services”). The following User Agreement (the “Agreement”) establishes a legally binding relationship between you and rekndle USA, INC. (“rekndle,” “we,” “us”). By engaging with the Services in any manner, you signify your acceptance of this Agreement, which will remain effective throughout your use of the Services. This Agreement encompasses the conditions outlined in this document, as well as those in the Privacy Policy, Warranty & Refund Policy, DMCA Policy, and any other relevant terms and conditions provided to you during the sale of Products. Additional policies, rules, and conditions (“Supplementary Terms”) may apply to certain Services. By using or participating in these Services, you acknowledge and agree to adhere to these Supplementary Terms.
Carefully review this Agreement as it contains critical information regarding your use of the Services. This includes details on potential modifications to these terms, limitations of liability, a waiver for class action, and the agreement to resolve disputes through arbitration instead of court proceedings. PLEASE BE AWARE: YOUR ACCESS AND USE OF OUR SERVICES ARE CONDITIONED ON YOUR ACCEPTANCE OF THESE TERMS; IF YOU DISAGREE WITH ANY PART OF THESE TERMS, YOU SHOULD REFRAIN FROM ACCESSING OR USING THE SERVICES IN ANY CAPACITY.
ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT WHERE SPECIFIED IN THE ARBITRATION AGREEMENT SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE HANDLED THROUGH BINDING, INDIVIDUAL ARBITRATION, THEREBY WAIVING YOUR RIGHT TO ENGAGE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.
Will this Agreement change? As we continuously seek to enhance our Products and Services, it may become necessary to amend this Agreement. We reserve the right to modify these terms at any time. Should changes occur, we will notify you via our website at https://rekndle.com, email, or other appropriate means.
If you disagree with the revised terms, you may choose to reject them. Unfortunately, this would mean you can no longer access or use the Services. If you continue to use the Services after the changes take effect, it will be assumed that you accept all modifications.
Apart from changes made by us as described here, no other amendments to this Agreement will be valid unless they are in writing and signed by both you and us.

Children’s Online Privacy Protection Act
The Children’s Online Privacy Protection Act (“COPPA”) mandates that online service providers must obtain parental consent before collecting personal information from children under 13 years of age online. We do not intentionally gather personal information from children under 16; if you are under 16, please do not use the Services or provide any personal information to us. If we discover that we have collected personal information from a child under 13, we will delete that information promptly. What are the basics of using rekndle? To use rekndle, you may need to create an account, choose a password and username (“rekndle User ID”), and provide specific information, like contact details. You commit to supplying accurate, complete, and updated registration information. You may not use a rekndle User ID that infringes on someone else’s rights or with the intention of impersonating another person. Your account is non-transferable without our prior written consent.
You assert and guarantee that you are legally capable of entering into a binding contract (or have obtained permission from your parent or guardian to use the Services, with them agreeing to these terms on your behalf if you are not). If you’re accepting these Terms on behalf of an organization or entity, you confirm you are authorized to do so and bind that organization or entity to these Terms (in which case, references to “you” and “your” in these Terms, except in this sentence, apply to that organization or entity).
The Services and Products obtained are for your personal, internal use, not for third-party benefits. You agree to adhere to all applicable laws in your use of the Services and your actions and omissions related to them. If your use of the Services or Products violates any law, you are not authorized to use the Services. We are not liable for any illegal use of the Services or Products.
Keep your rekndle User ID, account, password, and any other access tools confidential. You are responsible for any activity associated with your rekndle User ID and account.
Connecting Sellers and Buyers
rekndle facilitates connections between providers of certain electronics (“Sellers”) and those seeking these goods (“Buyers”). The term “you” in these Terms refers to any user, irrespective of being a Seller or Buyer. The terms “Seller” and “Buyer” apply specifically to those roles.
Before acquiring goods from any Seller (“Seller Goods”), Buyers should independently assess the suitability of the Seller Goods. rekndle’s responsibility is limited to connecting Sellers and Buyers and does not extend to guaranteeing the quality of Seller Goods or the accuracy of information provided by Buyers or Sellers. We have no control over and are not liable for the actions of any Buyer or Seller. Sellers are not rekndle employees.
rekndle does not directly offer Seller Goods. By using our Services, you acknowledge that rekndle does not oversee, direct, control, or monitor Seller Goods and disclaims responsibility and liability for them, including any warranties or compliance with laws or regulations.
Buyers and Sellers are prohibited from using the Services to form separate agreements regarding Seller Goods (“Outside Agreements”). Engaging in such activities may lead to account termination. rekndle is not a party to and bears no responsibility for enforcing any Outside Agreement.
What about messaging? Part of our Services includes sending communications, such as email or SMS. Upon signing up, you will receive a welcome message and information on how to opt-out of further messages. By signing up and providing your phone number, you consent to receive communications from rekndle, which may include automated texts. You agree to indemnify rekndle against any claims related to your breach of this agreement.
Are there usage restrictions for the Services? You agree not to contribute anything to the Services, or interact with the Services, in a way that:
- Infringes on the rights of rekndle or others;
- Violates any law or regulation;
- Is harmful, fraudulent, deceptive, or objectionable;
- Compromises the security of your or others' rekndle User ID or account;
- Attempts to obtain other users' security information;
- Violates network security or decrypts codes;
- Engages in unauthorized email, auto-responders, or spam;
- Overloads the Services' infrastructure;
- Crawls or scrapes data from the Services;
- Stores significant portions of Content without authorization;
- Attempts to decipher the source code of the Products or Services.
Violations of these terms may lead to termination of your access to the Services.
Are there specific terms for Sellers? Sellers must not collect or use Buyer Information beyond what is necessary to offer the Seller Goods. All Buyer Information must be handled in compliance with applicable laws. Upon the conclusion of transactions or upon request, Sellers must destroy all Buyer Information and cease its use.
What are my rights in the Services? The materials available through the Services, such as text, graphics, data, photos, and more (collectively, the “Content”), are protected by copyright and other intellectual property laws. You agree to respect these laws and not use, copy, modify, or exploit Content that you do not own without appropriate permissions.
We grant users a non-exclusive, non-transferable license to use Content for utilizing the Services. Any use, reproduction, or distribution of Content beyond this scope requires prior written permission from us. You acknowledge that rekndle owns the Services and agree not to replicate or exploit them beyond these Terms.
What about my contributions to the Services? User Submissions
Anything you post or provide through the Services is your “User Submission.” You are solely responsible for your User Submissions and represent their accuracy and compliance with laws and regulations.
You grant rekndle a worldwide, non-exclusive, perpetual license to use, modify, and exploit your User Submissions in connection with our business, including promoting and redistributing part or all of the Services. This license extends to other users for accessing and using your User Submissions. You retain the right to grant additional licenses to your User Submissions, unless otherwise agreed in writing.
Some Services features allow you to share information, including through third-party accounts. By sharing Content, you authorize rekndle to distribute that information with the relevant third-party account provider. You can edit or delete any redistributed Content, and must do so upon our request.
rekndle may need to modify your User Submissions to fit technical requirements, and the aforementioned licenses include these changes.
What if I find copyright infringement on the Services? We respect intellectual property rights and expect our users to do the same. We have a DMCA Policy for addressing copyright infringement, which can be found here: <LINK>.
Who is liable for what I see and do on the Services? You are solely responsible for the Content you access and contribute to the Services.
